Information clause

Your consent means that your personal data may be transferred to Biuro Informacji Kredytowej S.A. with the registered office in Warsaw, ul. Jacka Kaczmarskiego 77a, Warsaw (hereinafter referred to as “BIK”):

  1. in order to be made available by BIK to Currency Lending sp. z o.o. (hereinafter referred to as the “Company”), in response to an inquiry regarding information about you, including banking secrets, in order to carry out creditability assessment and credit risk analysis, and/or
  2. for the purpose of the processing by BIK of data regarding your liability under the concluded loan contract

Granting of the above consent means that BIK, apart from the Company – shall become the controller of your personal data. Below we present information on the processing of your personal data by BIK:

Data controller The controller of your personal data is Biuro Informacji Kredytowej S.A. with the registered office in Warsaw, ul. Jacka Kaczmarskiego 77a, 02-679 Warsaw (BIK)
Contact details BIK may be contacted via the following e-mail address: [email protected] or in writing (Centrum Obsługi Klienta BIK S.A., 02-676 Warsaw, ul. Postępu 17A). BIK appoints a data protection officer who may be contacted via the following e-mail address: [email protected] or in writing (Inspektor Ochrony Danych, Centrum Obsługi Klienta BIK S.A., 02-676 Warsaw, ul. Postępu 17A). You may contact the data protection officer in all matters relating to the processing of personal data and to exercising rights relating to the data processing.
The purposes and legal basis for theprocessing Your data shall be processed by BIK for the following purposes:
  • creditability assessment and credit risk analysis, including the use of profiling – the legal basis for the processing of personal data is your consent;
  • statistics and analyses, whose results shall not be personal data and whose results shall not serve as a basis for making decisions regarding a specific natural person - the legal basis for the processing of personal data is the legitimate interest consisting in the preparation for banks, loan institutions and other authorized institutions (data recipients), of products and services which support and enable proper management of the credit (loan) account and portfolio of the customers;
  • in order to handle your potential complaints and claims - the legal basis for the processing of personal data is the legitimate interest of the data controller, consisting in the examination of the complaint application and defence against potential claims.
Categories of thedata processed BIK processes the following personal data:
  • data identifying the person, including: PESEL number, first and last names, data regarding identity documents, date and place of birth, sex, citizenship;
  • address and contact details;
  • data relating to the liability, including: purpose and source of the liability, amount and currency, balance, period and terms of the liability repayment, legal security, course of the liability discharging, data regarding credit applications.
Source of data BIK obtains your personal data from the Company.
The period during which the data shall be processed BIK shall process your personal data:
  • for the purposes of creditability assessment and credit risk analysis, including profiling – for the duration of your liability or after its expiry – in any case no longer than 5 years after expiry of the liability in case of your consent, and with regard to the data referred to in the inquiry submitted to BIK – for a period not longer than 2 years from its submission;
  • for statistical purposes and analyses - for a period not longer than the period of your personal data processing for the purposes set forth in the point above;
  • for the purposes of handling your complaints and claims - until your potential claim for breach of the data processing becomes barred by statute of limitation.
Data recipients Your personal data may be made available by BIK to entities authorized to receive it on the basis of your consent, that is to banks, institutions authorized by law to grant credits, credit institutions, loan institutions and entities referred to in Article 59d of the Act of 12 May 2011 on consumer credit, as well as to the PESEL register or ID Cards Register in order to verify correctness of the personal data provided. Your personal data may also be submitted to entities which process data on behalf of BIK, such as IT service providers – with the proviso that such entities process data as subcontractors on the basis of a contract concluded with BIK and only according to BIK instructions.
Rights of the data subject

You have the right to access your data and the right to demand its rectification, deletion and restriction of processing. To the extent to which the basis for the processing of your personal data is the premise of a legitimate interest of the controller, you have the right to object to the processing of your personal data.

To the extent to which the basis for the processing of your personal data is consent, you have the right to withdraw your consent. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

To the extent to which your data is processed for the purpose of conclusion and performance of the contract or processed on the basis of the consent – you also have the right to transfer your personal data, that is to receive your personal data from the controller in a structured and commonly used machine-readable format. You may send this data to another data controller. The right to transfer data does not apply to data being a business secret.

You also have the right to file a complaint with a supervisory body responsible for the protection of personal data.

Information regarding credit intermediary and loan institution. The credit intermediary is Cinkciarz.pl Sp. z o.o., with it`s registered office in Zielona Gora (65-427) at 17B Wrocławska Street, phone number: +48 68 410 99 50, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court in Zielona Gora, VIII Commercial Division under the Registration number (KRS) 0000364722, Tax Identity Number (NIP) 9291830388, National Business Register Number (REGON)080465538 (“Credit Intermediary”). Share capital PLN 23,263,500.00

The Credit Intermediary, on the basis of agreements concluded with the cooperating loan institution, is authorized to perform factual and legal activities related to the preparation, offering and execution of lending service contracts, while the lending contract is concluded by a loan institution cooperating with the Credit Intermediary.

The Lender with whom the Intermediary cooperates is Currency Lending sp. z o.o. with its registered office in Zielona Gora, at Wrocławska 17B, 65-427 Zielona Gora, Poland, entered in the register of businesses maintained by the District Court in Zielona Gora, 8th Commercial Department of the National Court Register with the following number: KRS 0000291971, having NIP No. (Tax ID No.) 9730919039, having a share capital of PLN 2,128,500.00 ("Lender").

Please be informed that we operate on the basis of the provisions of Polish law specified in particular in the Consumer Credit Act and the Civil Code.

Representative example for a loan with withdrawal to a bank account: representative APR - 319.14%; total loan amount: 400 EUR; annual interest rate - 20.5% (fixed); total loan cost: 50.00 EUR, including: commission 43.26 EUR, interest 6.74 EUR; duration of contract: 30 days; total amount to be paid by the consumer: 450.00 EUR.

The calculation was made on 18.12.2022 on a representative example and is for informational purposes only. The granting and terms of the loan depend on the outcome of the assessment of the borrower's creditworthiness.

Consequences of late repayment. In case of delayed repayment of the granted loan, additional costs may be added, including delay interest in the amount of maximum interest for the delay as defined in art. 481 §2¹ of the Civil Code, i.e. double the amount of delay interest (delay interest is the sum of the reference rate of the National Bank of Poland and 5.5 percentage points). The Lender has the right to take debt collection measures to recover the claim and to demand the return of the Loan through court and enforcement proceedings. In case of delay in repayment of the Loan and after meeting the conditions specified by law, the Lender has the right to provide information about the Borrower's obligations to the Economic Information Offices and the Credit Information Bureau.

Complaints. The Financial Ombudsman is the entity authorized to settle a dispute arising from the contract between the Borrower and the Lender. Detailed information on the procedure, including contact to the Financial Ombudsman, is available at www.rf.gov.pl. The Borrower may also use the ODR platform to resolve a dispute with the Lender out of court: https://ec.europa.eu/odr/. The ODR platform shall be used for the out-of-court resolution of disputes by electronic means.
